Say YES to Protect the Citizens Right

I had filed a Complaint in the Central Information Commission for Knowingly and intentionally given false infromations under RTI ACT,2005 Section 18(1)(e). But the case was broadly mishandled by the Officials of Central Information Commission including the Information Commissioner. Then I have filed a Review Application on the grounds of "Mistakes, Manipulation, Dilution Of facts. But the CIC is not ready to review case. Because of the Reason that the provision of Review has been stopped by CIC wide the Notification No.CIC/Legal/2007/006 Dated: 20th October, 2008.

But it is against the Sections 19(9) and 19(10) of The RTI Act,2005. These sections giving the provision to seek review the cases.

Also, according to Code of civil procedure,

“The expression “review” is used in two distinct senses, namely,
(1) A procedural review which is either inherent or implied in a court
or tribunal to set aside a palpable erroneous order passed under a
misapprehension by it, and (2) a review on merits when the error
sought to be corrected is one of law and is apparent on the face of
the record……Obviously when a review is sought due to a
procedural defect, the inadvertent error committed by the Tribunal
must be corrected ex debito justitiae to prevent the abuse of its
process, and such power inheres in every court or tribunal.”

From the above facts the CIC has over shaded the Provision of RTI ACT,2005 Sections 19(9) and 19(10) by issuing the Notification No.CIC/Legal/2007/006 Dated: 20th October, 2008.

This is totally against the "Natural Justice and Citizens Right".
