Sir,
SUB: - stay operation against writ petitions filed by the widows whose husbands are

died prior to 01-04-1982

I, Tamma Ratnamala w/o late Krishna Murthy ex-teacher, Parlakhemundi Municipality beg to bring the few lines for your kind consideration and necessary immediate steps.

My husband late Krishna Murthy worked as non-government fully-Aided primary school teacher under Parlakhemundi municipality who worked nearly 24 years and died on 09/10/1981 while in service. The government has not sanctioned family pension to me till today i.e., more than 3 decades.

1. I may state that finding helpless for want of knowledge in local language I have left Parlakhemundi and had been to my native place, after the death of my late husband. Although I have made several representations for my legitimate claim of dues I was not favoured with any help from any corner. Infact I applied to the D.I of schools for grant of pension in 1994 which application was forwarded to the Controller of Accounts as well as Accountant General of Orissa since the pension was not given, and as per the direction of Accountant general Orissa I had approached the Hon'ble High Court of Orissa vide O.J.C No 9031/1999 by judgment dated 22/07/1999.

2. I may state that after filing of my application along with my Judgment i came to know that the Odisha state Government preferred stay operation against the family pensioners like me and there is a case in SLP CC (CIVIL) No. 5099-6054/2005 (Subarna Dibya & Ors VS State of Odisha) pending before the Hon'ble Supreme Court of India since 2005.

3. It may be stated that in this regard the Odisha state Government decision in this case is quit un-justice as the widows in the above Stay are nearly 55-65 years aged and they are waiting since 1981 to get their Husband's benefits which is their legitimate right.

4. i may state that the Job on compassionate grounds is depending on the state government policy but the family pension is a financial assistance to the families of the employees who rendered their services to the Government.

5. i may state that no one can decide to die like that way these employees who died while in service also like that way and in those hard days they cannot pre-planned to give proper source of maintenance to their livelihood and they leaved their families in the middle sea and after their death the Odisha state Government also leaved the widows on roads more so the Government even till today after completion of more than 30 years also trying to post pone the issue with the support of supreme court.

6. i may state that even if we verify the case proceedings of the supreme court in this case the case is still under substitute services / adding of Lrs stage it means that some of the widows are died and they waited for the family pension since till their death.

every year and every elections time the political parties announces so many policies to develop the below poverty line but the Odisha state government willfully and wantonly keeping these families under the poverty stage with the provisions of Indian Law.


In these circumstances I request all of you please try to verify the supreme court case status on the website for case No. SLP CC (CIVIL) No. 5093-6054/2005 (Subarna Dibya & Ors VS State Of Odisha) and support the widows of the Odisha State Government by sending petitions to the following persons

the Odisha State Government with the help the said Stay Order stopped sanctioning all the family pensions to the persons who died before 1-4-1982

1. The Chief Minister of Odisha

2. The Chief Justice, Supreme Court of India

3. The Educational Minister, School & Mass Education Odisha

4. The Secretary, School and Mass Education.
